Please read these Terms of Service ("Terms") carefully before downloading or using the Shyne iOS application (the "App") operated by William Sun ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Description of the App
Shyne is a personal habit-tracking application that generates a customised wellness routine based on preferences you enter. The App is intended for general wellness and informational purposes only.
3. Subscriptions and Billing
3.1 Subscription Plans. Access to the App's premium features requires a paid subscription. We offer the following plans:
- Annual Plan: $49.99 per year, billed annually. Includes a 3-day free trial for new subscribers.
- Monthly Plan: $9.99 per month, billed monthly.
3.2 Free Trial. The Annual Plan includes a 3-day free trial for new subscribers. Your free trial begins when you confirm the subscription. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged $49.99 for the first year.
3.3 Auto-Renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the rates stated above.
3.4 Managing and Cancelling Subscriptions. You may manage or cancel your subscription at any time through your Apple ID account settings. Go to Settings → [your name] → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; you will not receive a refund for the unused portion of the current period.
3.5 Price Changes. We reserve the right to change subscription prices. We will provide advance notice of any price changes. Any subscription price changes will take effect at the next renewal period and will be communicated by Apple in accordance with App Store policies.
3.6 Refunds. All purchases are made through Apple's App Store and are subject to Apple's refund policy. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent or attempt to circumvent any subscription or access controls
- Use the App in any way that could damage, disable, or impair the App
- Share your subscription access with others
5. Intellectual Property
The App and all content within it, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of William Sun or its content suppliers and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for your personal, non-commercial purposes.
6. User Data and Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. All personal preferences and habit data you enter are stored locally on your device and are not transmitted to our servers.
7. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not warrant that the habit suggestions or wellness content in the App are accurate, complete, reliable, or suitable for your individual circumstances.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL William Sun, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless William Sun and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
10. Third-Party Services
The App uses RevenueCat to process subscription payments. Your use of subscription features is subject to RevenueCat's terms and privacy policy. We are not responsible for the practices of RevenueCat or Apple's App Store.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance, support, or warranty services with respect to the App.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with a revised effective date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings.
